1. Purpose
This Damage & Liability Policy explains how SCLEO handles reports of property damage, personal injury, liability concerns, and related investigations involving bookings completed through the SCLEO Platform. This Policy should be read together with the Customer Terms & Conditions, Provider Terms & Agreement, Independent Contractor Agreement, Payment Terms, and Cancellation & Refund Policy.
2. Reporting Damage
Customers who believe property damage occurred during a booking should notify SCLEO as soon as reasonably possible and generally within forty-eight (48) hours after completion of the service. Providers are also expected to promptly report any accidental damage, safety incident, or property concern that occurs during a booking. Prompt reporting helps preserve evidence and allows for a more thorough investigation.
3. Information Requested
To investigate a reported incident, SCLEO may request information from the customer, the Provider, or both. Requested information may include: Photographs. Videos. Written descriptions. Receipts. Repair estimates. Booking records. GPS records. Check-in and check-out timestamps. Communications through the Platform. Before-and-after photographs where available. Service checklists. Witness statements, if available. Any other relevant information. Failure to provide requested information may affect SCLEO's ability to investigate or resolve a claim.
4. Investigation Process
SCLEO reviews reported incidents individually based on the available evidence. During an investigation, SCLEO may: Review booking records. Interview the customer. Interview the Provider. Review photographs and videos. Review communications. Review GPS and timestamp records. Request additional documentation. Consult insurance information where appropriate. Take other reasonable investigative steps. SCLEO will make reasonable efforts to conduct investigations fairly and impartially.
5. Provider Responsibilities
Providers are expected to: Exercise reasonable care while performing services. Follow SCLEO quality and safety standards. Immediately report accidental damage. Cooperate with investigations. Provide truthful information. Maintain any insurance required under SCLEO policies or applicable law. Intentional concealment, dishonesty, fraud, or refusal to cooperate may result in disciplinary action, suspension, or permanent removal from the Platform.
6. Determination of Responsibility
SCLEO investigates each reported incident individually based on the available evidence. After completing its review, SCLEO may determine that: The Provider was responsible. The customer was responsible. Neither party can be determined to be responsible based on the available evidence. Responsibility is shared. Additional information is required before a determination can be made. SCLEO will determine the appropriate resolution based on the available evidence, applicable agreements, insurance coverage, Platform policies, and applicable law. Nothing in this Policy guarantees that SCLEO will reimburse, compensate, or accept liability for every reported incident.
7. Insurance
Providers are responsible for maintaining any insurance required by SCLEO, applicable law, or their independent business operations. Where appropriate, SCLEO may request proof of insurance during onboarding, account verification, or the investigation of a reported incident. If insurance coverage is available, SCLEO may direct the parties to work with the applicable insurance carrier when appropriate. Nothing in this Policy creates an obligation for SCLEO to provide insurance coverage unless expressly stated in a separate written agreement.
8. Customer Responsibilities
Customers are expected to: Provide accurate information regarding the reported incident. Preserve relevant evidence where reasonably possible. Cooperate with SCLEO's investigation. Avoid making false, misleading, or fraudulent claims. Take reasonable steps to prevent additional damage where safe and appropriate. Knowingly submitting false or fraudulent claims may result in account suspension, account termination, denial of reimbursement, or other action permitted by applicable law.
9. Provider Misconduct
If SCLEO determines that a Provider intentionally caused damage, acted fraudulently, engaged in theft, intentionally misrepresented facts, or otherwise committed serious misconduct, SCLEO may take one or more of the following actions: Remove the Provider from the Platform. Withhold or recover payouts where permitted by applicable agreements and law. Report the matter to law enforcement or appropriate authorities where required or appropriate. Cooperate with insurance investigations. Pursue any other remedies available under applicable agreements or law. These actions are in addition to any other rights or remedies available to SCLEO.
10. Limitation of Liability
To the fullest extent permitted by applicable law, SCLEO's role is to operate and manage the Platform that connects customers with independent service providers. Except where otherwise required by law or expressly agreed in writing, SCLEO does not guarantee reimbursement for every reported incident, does not guarantee the performance of any Provider, and is not automatically responsible for damages, losses, or injuries arising from services performed through the Platform. Nothing in this section limits any legal rights that cannot be waived under applicable law.
11. Cooperation During Investigations
Customers and Providers are expected to cooperate in good faith during investigations conducted by SCLEO. Failure to cooperate, refusal to provide requested information, destruction of evidence, or intentional interference with an investigation may affect SCLEO's ability to resolve the matter and may result in actions permitted under SCLEO's policies or applicable law.
12. Changes to This Policy
SCLEO may update this Damage & Liability Policy from time to time. When material changes are made, SCLEO will update the "Last Updated" date and may provide additional notice through the Platform or by other reasonable means. Continued use of the SCLEO Platform after updated policies become effective constitutes acceptance of the revised Policy where permitted by applicable law.
